January 5, 2004The Moran City Council met in regular session on Monday, January 5, 2004. Mayor Phillip Merkel called the meeting to order at 7:00 PM. Councilmembers present were Mike Holman, Jerry Wallis, James Mueller, and Warren Johnson. Also present were Bret Heim, City Attorney; Shane Smith, Police Chief; Lori Evans, City Clerk; Mike Stodgell, City Superintendent; Loretta Roberts, Ambulance Director; and Barbara Shoate, Assistant Ambulance Director. Nealie Wilson was a visitor attending the meeting. Councilmember Mike Holman arrived at 7:28 P.M. Councilmember Mueller moved to approve the January consent agenda consisting of: December 2003 regular council meeting minutes, December pay ordinance totaling $59,565.95 and corporate resolution for purchase of a $20,000.00 certificate of deposit (CD) to replace a CD maturing January 9th. Warren Johnson seconded the motion, motion passed with all approving.
VISITORSNealie Wilson spoke with the Council regarding an incident that occurred December 24th when her pit bit a city employee, Jack McBride. Mrs. Wilson advised the Council that the pet that bit Jack only did so because Jack came on her property. To prevent the possibility of the pet biting another person, Mrs. Wilson and her husband had the animal put down.Mrs. Wilson informed the Council that she still has the female sibling of the pet that was destroyed and that the veterinarian has identified her pet as a Rottweiler/New Foundland mix. Mrs. Wilson said she did not believer her pet should fall under the strict regulations of a pure breed Rottweiler and requested the Council consider changing ordinance 1071 with regards to classification of the Rottweiler breed of dog to place the confinement restrictions on “whole” or “pure” breeds. Discussion followed regarding the lineage of Mrs. Wilson’s dogs. Councilmembers Wallis and Mueller expressed their concern with changing the ordinance and Councilmember Wallis said the City should apply ordinance regulations to all pet owners of Rottweilers. The Council agreed the ordinance should stand as written.
OLD BUSINESSPool Property - 408 N. Birch – The Council discussed the lack of improvements to the property and agreed to review the topic again in April. Chief Smith will check the property closer to the review date and send notice to the property owner if no additional improvements are made.Uniform Building Code and Building Inspector Duties – The Council discussed updating the Uniform Building Code and tabled any decision until the February meeting. The Council agreed to have Superintendent Stodgell continue with building inspections for the next month. Councilmember Wallis suggested giving Mayor Merkel the authority to call in a professional in the event a situation arises. No other action was taken.
NEW BUSINESS2004 Kansas Rural Water Association Conference – Councilmember Mueller moved to approve sending Superintendent Stodgell to the 2004 KRWA conference. Wallis seconded the motion, motion passed with all approving.Electric Safety Equipment Purchase – Superintendent Stodgell requested approved to purchase three insulation blankets and two pole covers for working electrical projects. He estimated the blankets would cost $425.00 with the pole covers estimated at $123.00 for a total of $789.00. Councilmember Wallis moved to approve the purchase of equipment. Mueller seconded the motion, motion passed with all approving.
Tire Purchase for 1997 GMC – Superintendent Stodgell requested approval to purchase four new tires for the 1997 GMC utility truck. Pricing estimates are as follows;
Councilmember Mueller moved to purchase the tires from Johnston Tire with Superintended Stodgell choosing between the $84.00 and $87.00 tires. Wallis seconded the motion, motion passed with all approving. 2004 Meeting Calendar – Clerk Evans noted the Calendar was drafted with regular meetings on the first Monday of each month with the exception of July and September due to holidays. For these months, the Council will meet on the Tuesday following the holiday. Councilmember Mueller moved to approve the proposed 2004 meeting calendar, Holman seconded the motion, motion passed with all approving.
DEPARTMENTAL REPORTSFire Chief – Chief Merkel reported the fire department was still outfitting the new rural truck. Councilmember Mueller informed the Council that Ralph Dozier, Treasurer of the Osage Township visited with him regarding the agreements between the City of Moran, Marmaton Township, and Osage Township for fire protection. Chief Merkel advised the Council that the City had no agreement with the rural fire departments and was only involved with the housing of equipment. Clerk Evans was asked to send a letter to both the Marmaton and Osage townships advising them that the City could no longer housing the 1959 Chevy fire truck due to lack of space and that the townships need to make other arrangements for housing the truck.Ambulance Director – Assistant Director Shoate advised the Council that the new ambulance was in but the radio and phone had not been transferred from the old to new unit. She then asked the Council for approval to purchase a CD/cassette player for the unit. Councilmember Wallis moved to approve the purchase with a limit of $300.00, Johnson seconded the purchase. Holman approved and Mueller abstained from the vote. Director Roberts requested approval to send seven EMT’s to the Kansas Emergency Medical Technician Association Conference the last weekend of March. She said the seven would include herself, Lee, Barbara, Bryan and Tina Miller, Sheri Smith, and Denise Byrd. Costs would include conference registration (unknown at this time) lodging, meals and mileage. The Council tabled the request until the conference costs were known. Approval was given to make room reservations in advance. Police Chief – Chief Smith asked the Council if the City could install keyed a like padlocks on the cages at the City pound so only one key was needed to open that cages. Superintendent Stodgell said it shouldn’t be a problem to do so. Chief Smith the Council if he could attend free training provided by the Iola Police Department at the end of January and beginning of February. He said that he needed forty hours training in 2004 to maintain his certification and this training would count toward these hours. Additionally, the Kansas Highway Patrol will offer training for commercial vehicle inspections in May. Council had no objections to the training. Chief Smith also advised the Council that he will need to recertify on the handgun. He suggested the Council consider trading the City’s 45 caliber for a 40 caliber. The Council suggested Chief Smith check in to trading the 45 for a 40. Chief Smith said the patrol car is running well, but needs new tires. The Council suggested having the car aligned before the City purchases new tires. Chief Smith will present estimates for new tires at the February meeting. The Council asked Chief Smith to continue citing owners with inoperable or untagged vehicles on their property. Superintendent – Superintendent Stodgell asked for approval for Asst. Superintendent Miller to attend the KRWA conference if he is able. Councilmember Mueller approved the request with Wallis seconding the motion. Motion passed with all approving. Superintendent Stodgell reported the following activities for the month of December:
The Council reviewed an invitation to join the League of Kansas Municipalities and agreed to decline the offer. Clerk Evans submitted a brochure promoting Xeriscape gardening for the Council’s review. The brochure was published as a water conservation guide as prescribed in the City of Moran’s Water Conservation Plan. Councilman Wallis moved the meeting adjourn at 9:44 PM. Mueller seconding the motion, motion passed with unanimous approval.
